Sometime during the renewal of the Patriot Act, the Bush White House argued that intercepted data was not subject to 4th Amendment protections when it was simply "obtained" and stored on a server, but only when a government employee or law enforcement sought to "retrieve" it, thus not requiring probable cause to store all our data in Utah like they're doing now.
