When buying a used phone, how can you be sure it's not stolen?

I have this phobia that I will buy a used phone and the next day the police will raid my house. When buying a used phone, is there a sure way to tell that the phone has not been used for drug dealing, the previous owner is not wanted, and the phone is not stolen? or should I just stick with new to avoid all these problems?
