If personal devices really did record us, audio and or video, without our consent, wouldn‘t they have been used in court proceedings by now?

Hi. I lurk this sub and personally do have the somewhat paranoid belief that my phone and computer could be recording me without my consent. But where does that information, or where would it, go? If it was happening, couldn‘t it be accessed? And if it could be accessed, wouldn‘t it have been used in prosecution by now? Or defense?
